    Medicaid Asset Protection Plan

    My 84 year old mother is about to enter a long term care facility.  We spoke with an elder care attorney who told us that there is a legal way to protect her few remaining assets and get Mom approved for Medicaid.  Is anyone familiar with this process?  Has anyone been successful in getting this done.  Note:  We are not tring to defraud Medicaid, just trying to protect what little remains after her and Dad worked (combined) more than 100 years.

    I am interested also.  I did get my Dad to start a resource assesment to see what needs to be spent down before appling for Medicaid.  I had gotten a number for legal aide society which informed me how to begin this. They also mentioned asking at the medicaid office if they had a list of Medicaid annalists that used to work for them (that are probably retired now ) if we were not satisfied with the outcome of the resource assesment.  Supposidly in my area they charge $75-$125 an hour.  When I asked the person starting the resource assesment if she had a list she said she never heard of that type person.  It is a shame that we have to try to protect what little money is left after working so hard and paying for so much for care be it medical or as the government likes to call non-medical care.  But if one needs help with ADL's the government does not help.

    Medicaid Asset Protection is recognized by case law as a viable planning tool to protect both the estate of the Medicaid recipient, but also the well-being of the community spouse.  The courts have said that Medicaid planning can and should be done because it is what a prudent individual would to.
